Exclusive Warranty and Limitations of Remedies

THIS DOCUMENT CONSTITUTES THE EXCLUSIVE WARRANTY AND SOLE REMEDIES PROVIDED BY THE ROOF STORE. THE WARRANTY AND REMEDIES CONTAINED IN THIS DOCUMENT ARE EXPRESSLY IN LIEU OF ANY AND ALL OTHER OBLIGATIONS, GUARANTEES, WARRANTIES AND REPRESENTATIONS, WHETHER WRITTEN, ORAL, IMPLIED BY STATUTE, AT LAW OR IN EQUITY, INCLUDING WITHOUT LlIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR USE AND FITNESS FOR A PARTICULAR PURPOSE. SOME STATES OR JURISDICTIONS MAY NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES OR MAY DETERMINE THE PERIOD OF TIME FOLLOWING THE SALE THAT A PURCHASER MAY SEEK A REMEDY UNDER IMPLIED WARRANTIES, SO THE ABOVE EXCLUSION MAY NOT APPLY TO YOU.

THE ROOF STORE’S OBLIGATIONS, RESPONSIBILITIES, AND LIABILITY SHALL BE LIMITED TO REPAIRING OR REPLACING THE DEFECTIVE PRODUCT AS SET FORTH IN THIS LIMITED WARRANTY. IN NO EVENT SHALL THE ROOF STORE BE LIABLE FOR ANY PUNITIVE, SPECIAL, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING ANY DAMAGE TO THE PROPERTY, THE BUILDING OR ITS CONTENTS, OR FOR INJURY TO ANY PERSONS, THAT MAY OCCUR AS A RESULT OF THE USE OF THE ROOF STORE’S PRODUCTS OR AS A RESULT OF THE BREACH OF THIS WARRANTY. IF YOUR STATE OR PROVINCE DOES NOT ALLOW EXCLUSIONS OR LIMITATIONS OF PUNITIVE, SPECIAL, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES, THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

IN NO EVENT SHALL THE ROOF STORE’S TOTAL LIABILITY ARISING OUT OF OR RELATED TO THE PRODUCT(S) OR THIS WARRANTY EXCEED THE COST OF REPLACEMENT THE ROOF STORE SYNTHETIC UNDERLAYMENT, THE LABOR COSTS RELATING TO THE INSTALLATION OF SUCH REPLACEMENT THE ROOF STORE SYNTHETIC UNDERLAYMENT AND, ONLY IF THE ROOF STORE SHINGLES WERE INSTALLED ABOVE THE ROOF STORE SYNTHETIC UNDERLAYMENT, THE COST TO RE-INSTALL THE ROOF STORE SHINGLES AND THE NECESSARY REPLACEMENT THE ROOF STORE SHINGLES.

Any payments made pursuant to this Limited Warranty will be made in the value U.S. dollars. This Limited Warranty may not be modified, altered or expanded by anyone, including product distributors, dealers, sellers and/or The Roof Store field representatives. This Limited Warranty gives you specific legal rights and you may also have other rights which vary from State to State or Province to Province.

Effective Date

This Limited Warranty is effective for The Roof Store Synthetic Underayment installed within the Continental United States, Hawaii after January 1, 2025. For current information, visit www.theroof.store

What and Who is Covered and For How Long

The Roof Store Corporation (“The Roof Store”) warrants to you, the original owner of The Roof Store Synthetic Underlayment that when subject to normal and proper use, The Roof Store Synthetic Underlayment will be free from manufacturing defects for the length of the warranty term. In the event that The Roof Store Synthetic Underlayment is installed underneath shingles manufactured by The Roof Store, The Roof Store warrants The Roof Store Synthetic Underlayment for the same length of time applicable for the installed The Roof Store shingles. In the event that roofing shingles not manufactured by The Roof Store are installed over

The Roof Store Synthetic Underlayment, this Limited Warranty extends for ten (11) years from the date of The Roof Store Synthetic Underlayment purchase date according to the Order Number assigned on the Order Confirmation email received by the buyer. The warranty period starts from the date of Order and terminates if either The Roof Store Synthetic Underlayment or the overlying roofing materials are removed.

For any portion of your The Roof Store Synthetic Underlayment that The Roof Store determines has a manufacturing defect, The Roof Store will contribute to the cost of either repairing or replacing your The Roof Store Synthetic Underlayment, as follows.

The Roof Store Protection

‍

Under The Roof Store warranty feature, for the first three years after installation of The Roof Store Synthetic Underlayment:

(1) If The Roof Store shingles are installed: The Roof Store will pay you the reasonable cost of

labor to repair or replace The Roof Store Synthetic Underlayment, including labor to re-install both it and The Roof Store shingles over the affected portion (exclusive of roof tear off, metal work, flashings, disposal expense and other related work), and will provide replacement

The Roof Store Synthetic Underlayment and The Roof Store shingles.

(2) If non-The Roof Store Architectural Shingles are installed: The Roof Store will pay you the reasonable cost of labor to repair or replace the defective The Roof Store Synthetic Underlayment including labor to re-install the replacement The Roof Store Synthetic Underlayment only over the affected portion (exclusive of shingles or other

roofing material, tear off, metal work, flashings, disposal expense and other related work),

and will provide the replacement The Roof Store Synthetic Underlayment.

After The Roof Store Protection

‍

After The Roof Store Protection period, should The Roof Store determine that your The Roof Store Synthetic Underlayment has a manufacturing defect, The Roof Store’s maximum contribution toward the cost of repairing or replacing The Roof Store Synthetic Underlayment at The Roof Store’s sole option, will be based on providing replacement The Roof Store Synthetic Underlayment in an amount calculated by dividing the remaining number of months in the warranty period by the total number of months of the warranty period, and multiplying that amount by the original cost you paid for The Roof Store Synthetic Underlayment excluding the cost of labor, shingles or other roofing material, metal work, flashings, disposal expense and other related work. In the event that you are unable to provide an original proof

of purchase for The Roof Store Synthetic Underlayment, The Roof Store will not cover anything. The cost of labor to re-install your The Roof Store Synthetic Underlayment and the costs related

to your shingles are not included in the repair or replacement. Decisions as to the required extent of repair or replacement will be made solely by The Roof Store. The Roof Store reserves the right to arrange directly for your The Roof Store Synthetic Underlayment to be

repaired or replaced instead of reimbursing you for such work. The remedy under this Limited

Warranty is available only for that portion of your The Roof Store Synthetic Underlayment actually exhibiting manufacturing defects at the time the claim is submitted to The Roof Store. Any replacement The Roof Store Synthetic Underlayment as well as any remaining original The Roof Store Synthetic Underlayment will be warranted only for the remainder of the

original warranty period. The Roof Store reserves the right to discontinue or modify The Roof Store Synthetic Underlayment.

Transferability: Remedy for the Second Owner

‍

This Limited Warranty may only be transferred once – from the original owner to the first

subsequent owner as follows:

(a) If the transfer takes place within the first three (3) years after installation of The Roof Store Synthetic Underlayment (The Roof Store Protection Period), the second owner shall be entitled to all benefits contained in this warranty as the original owner.

(b) If the transfer takes place after the first three (3) years of installation, the length of this

warranty shall be limited to two (2) years after ownership changes. During this two-year

period, The Roof Store will provide replacement The Roof Store Synthetic Underlayment as calculated in the “After The Roof Store Protection Period” section above.

Limitations of Coverage

‍

This Limited Warranty does not provide protection against, and The Roof Store will have no

liability for any failure, defect or damage as a result of, including but not limited to:

‍

(1) Damage to your The Roof Store Synthetic Underlayment not resulting from a manufacturing defect in your The Roof Store Synthetic Underlayment including such things as:

(a) Improper installation of your The Roof Store Synthetic Underlayment or application not in strict accordance with The Roof Store’s published application instructions.

(b) Exposure to the elements (except for damages resulting from UV degradation if

left exposed for less than 30 days).

(c) Settlement, movement or defects in the building, walls, foundation or the roof

base over which The Roof Store Synthetic Underlayment is applied.

(d) Inadequate attic ventilation or application of The Roof Store Synthetic Underlayment directly to insulation or to an insulated deck.

(2) Damage to your The Roof Store Synthetic Underlayment resulting from causes beyond normal wear and tear such as:

(a) Acts of nature (such as hail, windstorms, hurricanes or tornados) or ice damming.

(b) Impact of foreign objects or traffic on the roof.

(c) Improper storage or handling of your The Roof Store Synthetic Underlayment.

(3) Leaks caused by fasteners.

(4) Damage caused by structural changes, alterations or additions, or by the installation

of equipment (such as, but not limited to, aerials, signs or air-conditioning equipment)

to the building after The Roof Store Synthetic Underlayment has been applied.

(5) Labor costs (except as specifically provided for above), disposal costs, and any costs

relating to shingles (except as specifically provided for above), metal work, flashings

and roof deck.

(6) Damage to the interior or exterior of any building, including, but not limited to, mold growth.

Claims: What You Must Do

‍

To file a claim under this Limited Warranty, you must email a notice of claim in writing,

together with proof of purchase to establish that you are the original owner (or proof of

transfer if the second owner has properly transferred coverage), and proof of application

date to: info@theroof.store within 30 days after your discovery of the alleged defect. 

NOTE: Notice to your contractor, dealer or home builder is NOT notice to

The Roof Store. Within a reasonable time after proper notification, The Roof Store will evaluate your claim and resolve it in accordance with the terms of this Limited Warranty. The Roof Store may require you to submit, at your expense, sample The Roof Store Synthetic Underlayment for testing and photographs.
